I wasn't agreeing or disagreeing.
Just asking if people vote for the person or the party. I think the answer would be divided. As said a by-election would be a back or sack scenario to solve this.
The other option would be if you defect it goes to the 2nd in command in that seat, but that goes back to do people vote for the person or the party. Not ideal in any way shape or form, as is the timings.
It would be a bit daft (IMO) to have a by-election (which I assume takes a while to set up logistically?), and then have an actual election a few weeks or months later. Should there be a time frame on it?

**You have a point, but where would the line be drawn in that time frame? Let's say three months? So..........
Say I was an MP, but was getting disillusioned with the party I represented, and was thinking of defecting to the other side. I could bite my tongue until one day into those three months, declare I was jumping ship, and see my time out without having to ask the "Back me, or sack me!" question to my (now unfairly represented) constituents!
No mate, and at the risk of boring you all, It should be written into our country's constitution, that.......
"If any MP moves from one party to another, that person should resign her / his seat, and a by-election must immediately be called."
Spelly.
Just a thought, but would the demand for an immediate by-election also apply to those constituencies, when a Party removes the Party whip in Parliament eg Jeremy Corbyn, Diane Abbot, Andrew Bridgen etc, who remain in Parliament as Independents?
On the question of timing, in local government, when a vacancy occurs within six months of an ordinary day of election (in May), the by-election to fill the vacancy is delayed until that date. Not sure how this can be applied to Parliamentary elections, which can be called at any time by the PM during the five year term.
I am not sure that there is any need to change the Constitution at all, but perhaps it would be more democratic if, in these circumstances ie defecting MP or removal of Party whip, local people through a recall petition could call for the dismissal of the MP and for an election to be held.

Good points mate!
